Liability Waiver & Release of Claims

Assumption of Risk

I, the undersigned participant, acknowledge that UTV (Utility Task Vehicle) operation and off-road trail riding are inherently dangerous recreational activities. I understand that participation involves risks that may result in serious bodily injury, permanent disability, or death. These risks include, but are not limited to:

• Vehicle rollover, collision, or mechanical failure
• Ejection from the vehicle
• Rough, uneven, or unpredictable terrain conditions
• Exposure to dust, mud, water crossings, and debris
• Encounters with wildlife, insects, or vegetation
• Changing and adverse weather conditions including rain, wind, and extreme temperatures
• Actions or negligence of other riders, drivers, or third parties
• Equipment failure despite proper maintenance
• Remote trail locations with limited access to emergency medical services

I voluntarily assume full responsibility for any and all risks of injury, illness, damage, or loss that may occur as a result of my participation.

Release & Waiver of Liability

In consideration of being permitted to participate in UTV rental and trail activities provided by Laurentian Adventures, LLC, its owners, officers, employees, agents, volunteers, and affiliates (collectively, "Released Parties"), I hereby release, waive, discharge, and covenant not to sue the Released Parties from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, or injury, including death, that may be sustained by me or my property, whether caused by the negligence of the Released Parties or otherwise, while participating in these activities.

Indemnification

I agree to indemnify, defend, and hold harmless the Released Parties from any loss, liability, damage, cost, or expense (including attorney's fees) that they may incur as a result of my participation in activities, including any claim made by a third party arising from my actions or negligence.

Medical Authorization

I authorize Laurentian Adventures, LLC and its staff to obtain or provide emergency medical treatment for me in the event of injury or illness during my participation. I understand that I am responsible for all medical costs incurred. I certify that I have no medical conditions that would prevent safe participation, or I have disclosed all such conditions to the Company prior to participation.

Participant Responsibilities

By signing this waiver, I confirm that:

• I am at least 18 years of age and possess a valid driver's license (if operating a vehicle)
• I will attend and complete the mandatory safety briefing before operating any vehicle
• I will wear all required safety equipment, including helmet and seatbelt, at all times
• I will not operate a vehicle under the influence of alcohol, drugs, or any impairing substance
• I will follow all posted rules, trail markers, speed limits, and staff instructions
• I will remain on designated trails and will not enter restricted or private areas
• I will immediately report any accident, injury, vehicle damage, or unsafe condition to staff
• I am financially responsible for damage to the vehicle caused by my negligence, recklessness, or violation of rules

Media Release

I grant Laurentian Adventures, LLC the right to use photographs, video, or other media taken during my participation for promotional and marketing purposes, including use on the Company's website, social media, and printed materials. I waive any right to compensation or approval for such use. If you wish to opt out of media use, please notify staff at check-in.

Minors

If the participant is under 18 years of age, a parent or legal guardian must sign this waiver on their behalf. By signing, the parent or guardian agrees to all terms herein on behalf of the minor and assumes responsibility for the minor's conduct and safety.

Governing Law

This waiver shall be governed by and construed in accordance with the laws of the State of Minnesota. Any disputes arising from this waiver or my participation shall be resolved in the courts of St. Louis County, Minnesota. If any provision of this waiver is found to be unenforceable, the remaining provisions shall remain in full force and effect.

Acknowledgment

I have read this Liability Waiver and Release of Claims in its entirety. I fully understand its terms and understand that I am giving up substantial rights, including the right to sue. I sign it freely and voluntarily without any inducement.
